In 2010, Frederick J. Hanna & Associates, P.C., a collection law firm located in Georgia began aggressively pursuing our client on behalf of a Bank of America credit card account that had defaulted. When Bank of America begins collection action or a lawsuit, they often confuse consumers because their corporate name is actually FIA Card Services, N.A., and consumers have no idea whom this creditor is or that they are related to their Bank of America debt.
In this case, FIA Card Services, N.A., through Frederick J. Hanna & Associates, P.C., pursued our client for an alleged defaulted credit card debt of over $40,000. After some time the debt was transferred to a local law firm that sued our client, Forster & Garbus, LLP. They filed suit in the Supreme Court of Rockland County and went back and forth with our client’s attorney for over two years without any progress or settlement negotiation. After two years, FIA Card Services, N.A., dropped Forster & Garbus, LLP as counsel and retained Mullooly, Jeffrey, Rooney & Flynn LLP another major NY debt collection law firm to represent them.
Mullooly, Jeffrey, Rooney & Flynn LLP usually handles most if not all of FIA Card Services, N.A.’s collection lawsuits in NY. Mullooly, Jeffrey, Rooney & Flynn submitted a very detailed motion for summary judgment and our client retained our office after seeing no results and mounting legal fees from his prior counsel. After a thorough examination of the evidence and detailed discussions of the possible outcomes at trial, we were able to secure a settlement of $13,000 for our client, paid in installments, off of the total debt which was over $40,000 excluding additional interest and attorney’s fees. That settlement amounted to approximately 70% off of the total debt, and a savings of $27,000. As FIA Card Services, N.A. is an original creditor, this was an excellent settlement for our client. The payment plan on this Mullooly, credit card lawsuit was also interest free, an added bonus that we are almost always able to obtain.
